2013 Official Rules

1. Participation The Promotion is open only to residents of the 50 United States and DC who are eighteen (18) years of age or older at the time of participation. Persons in any of the following categories are NOT eligible to participate or win prizes in the Promotion: (a) any person was or is an owner or employee or a director, officer, employee, agent, or independent contractor of: Tours4fun.com; any of their respective parent companies, subsidiaries, affiliated companies or service agencies; and any entities retained by Tours4fun.com for the administration of the Promotion; (b) individuals who are engaged in the development, production or distribution of Promotion materials or the prize supply for the Promotion; and (c) persons who are immediate family members (defined as spouse, IRS dependent, or biological, adoptive or step- mother, father, sister, brother, daughter or son, and each of their respective spouses) of, or who reside in the same household as, any person in any of the preceding categories. Void outside the 50 United States, DC and where prohibited.

2. Acceptance of the "Weekly sweepstake rules" By agreeing to participate to the sweepstake you are expressly agreeing to these rules (the “Weekly Sweepstake Rules”). Valued Opinions as used in these rules means Tours4fun.com, including all affiliates and subsidiaries and their successors and assigns. If you do not agree to the Sweepstake rules, please select NO or do not complete the form in this page https://www.tours4fun.com/landing/theme-park-tickets-sweepstakes.html. By completing the form, you affirm you are 18 years of age or older, or an emancipated minor, or possess legal parental or guardian consent to complete the survey, a U.S. resident and are fully able and competent to enter into, accept, and comply with these Terms of Service. The survey and prizes is not intended for children under 18. If you are under 18 years of age, please do not complete the form.

3. Governing law All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of the Participant, or Sponsor in connection with the Promotion shall be governed by and construed in accordance with the internal laws of the United States of America without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state's laws.

4. Arbitration disclosure By participating in this Promotion in the applicable states of the United States and D.C. each Participant agrees that: (1) any claim, dispute, or controversy (whether in contract, tort, or otherwise) Participant may have against the Releases arising out of, relating to, or connected in any way with the Sweepstakes, the awarding or redemption of Prizes, or the determination of the scope or applicability of this agreement to arbitrate, will be resolved exclusively by final and binding arbitration administered by American Arbitration Association ("AAA") and conducted before a sole arbitrator pursuant to the applicable Rules and Procedures established by AAA (“Rules and Procedures”); (2) this arbitration agreement is made pursuant to a transaction involving interstate commerce, and shall be governed by the Federal Arbitration Act (“FAA”), 9 U.S.C. §§ 1-16; (3) the arbitration shall be held at a location determined by AAA pursuant to the Rules and Procedures (provided such location is reasonably convenient for Participant), or at such other location as may be mutually agreed by the Participant and Sponsor; (4) the arbitrator’s decision shall be controlled by the terms and conditions of these Official Rules and any of the other agreements referenced herein that the applicable Participant may have entered into in connection with the Promotion; (5) the arbitrator shall apply Illinois law consistent with the FAA and applicable statutes of limitations, and shall honor claims of privilege recognized at law; (6) there shall be no authority for any claims to be arbitrated on a class or representative basis, arbitration can decide only the Participant’s and/or Sponsor’s individual claims; the arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated; (7) the Participant and Sponsor shall be entitled to recover punitive, incidental and/or consequential damages only to the extent permitted by law (8) in the event that the administrative fees and deposits that must be paid to initiate arbitration against Sponsor exceed $125 USD for claims less than $10,000 or $375 for claims greater than $10,000 but less than $75,000, and the Participant is unable (or not required under the applicable Rules and Procedures) to pay any fees and deposits that exceed this amount, Sponsor agrees to pay them and/or forward them on the Participant’s behalf, subject to ultimate allocation by the arbitrator. In addition, if the Participant is able to demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, Sponsor will pay as much of the Participant’s filing and hearing fees in connection with the arbitration as the arbitrator deems necessary to prevent the arbitration from being cost-prohibitive; and (9) with the exception of subpart (6) above, if any part of this arbitration provision is deemed to be invalid, unenforceable or illegal, or otherwise conflicts with the Rules and Procedures established by AAA, then the balance of this arbitration provision shall remain in effect and shall be construed in accordance with its terms as if the invalid, unenforceable, illegal or conflicting provision were not contained herein. If, however, subpart (6) is found to be invalid, unenforceable or illegal, then the entirety of this Arbitration Provision shall be null and void, and neither Sponsor nor Participant shall be entitled to arbitrate their dispute. 5. User submission To enter the weekly prize draw the panelist must participate in the online form. Participation includes fully complete, not qualified and late entry. By invitation only and subject to the agreement of the Terms and Conditions. Entry to the prize draw on completion of the survey in full is automatic.

6. There is a weekly prize draw which opens 14 Sep 2013 and closes at midnight 6 Oct 2013

7. No purchase is necessary to enter the promotion. Internet access required.

8. One entry per person per survey for the duration of the promotional period. No more than one “User submission” may be registered per person. Multiple “User submissions” will be disqualified as will individuals acting on behalf of third parties or syndicates. All registrations associated with such activity will be terminated.

9. There are 6 Themepark tickets available to be won over the promotional period. There are 3 themepark ticket draws in total - one winner per week over the promotional period.

10. Winners are selected from all valid entries received every week via a random computerized draw selection process which will be carried out the next Monday after the relevant close date.

11. Winners will be contacted by email within 2 working days of the prize draw being carried out and must respond within 48 hours to claim their prize, providing full address information and contact details for prize fulfillment. Failure to respond within this time will mean that the prize will be forfeited and the promoter reserves the right to re-allocate the prize to the next reserve selected at random at the time of the original draw. Prizes will be dispatched up to 7 days after confirmation of prize.

12. Winners 1st name and city will be displayed on www.tours4fun.com for a period of 1 month following the closing date.

13. No entrant can use their computer, via brute force or script, to enable multiple entries or multiple accounts or to undermine the promotion. In this event that person’s entry and all other associated entries will be disqualified and any prize award will be withheld.

14. No third party entries, bulk entries or entries submitted by agents will be accepted. The Promoter reserves the right to verify the eligibility of entrants. The Promoter may require such information as it considers reasonably necessary for the purpose of verifying the eligibility of an entry and the prize may be withheld until and unless the Promoter (in its sole discretion) is satisfied with the verification. The Promoter’s decision is final.

15. All entries and materials submitted (“Material”) must be the entrant’s own original work and must not infringe the copyright or other intellectual property rights of any third party. Any entry found to be copied, lifted from other sources, used/submitted for another survey or the work of author, will be disqualified. The Material submitted must not contain any infringing, threatening, false, misleading, abusive, harassing, libelous, defamatory, vulgar, obscene, scandalous, inflammatory, pornographic or profane content. All entries will be subject to moderation and must not contain any brand references or imagery.

16. By entering the Promotion, winners acknowledge that they will be required to participate in publicity relating to the Promotion without further consent or payment. Such publicity may include, without limitation, the participants first name and city and statements made by the participants concerning the promotion.

17. In the event of an email address becoming inaccessible during the promotion, Tours4fun.com is not able to retrieve and amend any existing entries to a new email address.

18. Prizes are non-transferable. There are no cash alternatives in whole or in part. In the unlikely event of one the prizes not being available the promoter reserves the right to offer an alternative or equal or similar value. The Promoters decision is final in all promotional matters.

19. Entrants’ data will be securely collected, stored and processed for the purposes of administering and assessing this prize draw only and for future promotions (at the option of the entrant) and for the Prize Winner and the Companion for the fulfillment of the prize, which may involve exchange of information with third party service providers.

20. The content of the data is made available to you for your information and personal use. It may not be used, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, downloaded, or otherwise exploited in any manner not intended by the normal functionality of Valued Opinions or otherwise as prohibited under these rules.

21. By entering the promotion, entrants assign the Material transmitted as part of the above Promotion and all intellectual property and other rights associated with the Material to the Promoter or its nominee unconditionally. For the avoidance of doubt, the Material may be used Valued Opinions, the Promoter and any member of for any purpose in any media anywhere in the world, including but not limited to copying, issuing copies to the public, communication to the public, making an adaptation, or any of the aforesaid in relation to adaptations.

22. To the extent that assignment is not possible, entrants grant the Promoter and Valued Opinions an exclusive, irrevocable, royalty free license to use the Material for any purpose in any media anywhere in the world. Entrants agree to execute any further such paperwork as may be necessary to give full effect to these terms & conditions, in particular to perfect the assignment to the Promoter or its nominee of the Material submitted.

23. Entrant winners irrevocably waive their moral rights, or rights equivalent to moral rights, in the Material submitted to the greatest extent permitted by law.

24. The Promoter is not responsible for any data lost, damaged, delayed either inbound or outbound, or not received online, or for network, computer hardware or software failures of any kind, which may restrict or delay entry.

25. All entrants will be deemed to have accepted and be bound by these terms and conditions as specified and any requirements set out in the accompanying promotional material.

26. Events may occur that render the promotion itself, awarding or the delivery of any prize impossible due to reasons beyond the control of the Promoter and accordingly the Promoter may at its absolute discretion vary or amend the Promotion and the participant agrees that no liability shall attach to the Promoter as a result thereof.
